Notice About Earlier Versions of Our Service Agreement and Termination Agreement
Last Updated: November 2, 2026
This notice applies to clients who accepted our Service Agreement dated September 19, 2025 ("2025 Service Agreement"), and to cancellations made under our Termination Agreement dated September 19, 2025 or Version TA-2026-10-INT1 ("Earlier Termination Agreements").
This notice only limits what Young Event Group LLC dba A Twist of Lime ("we") will do. It does not add anything you must do, and it does not take away any right you have. It does not change the deposit, payment dates or cancellation amounts in the agreement you accepted. Each commitment below is permanent and applies to past and future events under those agreements.
2025 Service Agreement
- Time limit for claims. "All claims against Bar Service must be made in writing within sixty (60) days of the event date or they are forever barred." We will not enforce this. We will not treat any claim as barred unless the time allowed by law has run.
- "As is" services. "Bar Service provides all services 'as is' without any warranty of any kind…" We will not enforce this. We will treat our services as provided with reasonable skill and care.
- Liability cap and exclusions. "Bar Service's total liability … arising by any means … shall not exceed the total amount paid…," together with the "Specific Liability Exclusions" and the similar limit under "Handling & Delivery Liability Protections." We will not use these to limit our liability for fraud, willful injury, gross negligence, violation of law, or anything else California law does not allow to be limited.
- Defense of groundless claims. "Client agrees to provide legal defense for Bar Service at Client's expense for any covered claims, even if the claims are groundless, false, or fraudulent." We will not enforce this. We also will not seek indemnity from you for any claim to the extent it was caused by our negligence, gross negligence, willful misconduct or violation of law.
- Exclusive venue and venue waiver. "…shall be brought and maintained exclusively in the state or federal courts located within Santa Clara County…" and "Client also waives any right to challenge the venue or jurisdiction of California courts." We will not enforce these against a client who is an individual. You may bring or defend a court case in any county where California law makes venue proper, and in small claims court.
- Photo objection fee. "…may be subject to a documentation fee of $100…" We will not charge it. You may tell us at any time, at no charge, that you do not want photos or video taken at your event.
- Guest images in marketing. "All photos and videos taken by Bar Service during the event are the sole property of Bar Service with unlimited usage rights including … Third-party marketing partnerships." We will take down any image of you or your guests on request, and going forward we do not use identifiable guests or minors in marketing without consent. To ask, email events@atwistofli.me.
- Forfeiture of all payments for reasons other than cancellation. The 2025 Service Agreement says that all deposits and payments are forfeited, or retained, if we cancel because the guest count exceeds the headcount by more than 10%, because the Load In/Out Survey or documentation is not completed, because of an assignment, sublease or loan, or because of inadequate access. If we cancel for any of these reasons, we will keep or collect no more than the payments you had made plus any balance that was already due on that date under the 2025 Service Agreement.
- Returned-check fee. "…any checks returned due to insufficient funds will incur a $50 processing fee." We will not charge more than California law allows: $25 for the first returned check and $35 for each later one. We will not add a late fee on top of a returned-check fee for the same payment.
Earlier Termination Agreements
- Client release. Section 4.1: "Client … hereby releases, waives, and forever discharges Bar Service … from any and all claims…" We will not rely on this release to defend against any claim. Your rights and claims are the same as if you had not signed it.
- Two-year non-solicitation. Section 5.2: "For a period of two (2) years from the Effective Date, Client agrees not to: Directly or indirectly solicit, hire, or attempt to hire…" and the bullets that follow. We will not enforce Section 5.2. Nothing in those agreements limits any person's right to work for anyone. We charge no placement or similar fee.
- Reviews and statements. The Termination Agreement dated September 19, 2025 contained a Non-Disparagement section (5.3), and Section 5.2 included a bullet barring use of confidential information to "disparage" us. Those provisions are void as to your right to make statements. We waive and release them, and we will not enforce or threaten to enforce them.
